Dear IV members,
As of 23 September 2006, we have received less than 15 questions in preparation for the next call. This does not meet the critical mass of 20-25 questions for justifying a conference call.
Please follow process listed in the thread http://immigrationvoice.org/forum/showthread.php?t=1267 for us to consider your questions.
Also, please spread the word around.
I am attaching a flyer for your convenience. You could request your friendly neighborhood ethnic grocer (Indian/Mexican/Chinese/Filipino and others) or video rental store, religious gathering or communal gathering place to carry these flyers in a prominent location. (You'll be surprised at the positive response you will get from such businesses- I had my reservations at first, but when I approached a temple sometime back, the temple officer appreciated the efforts made by us for such a "great cause"- his own words).
NOTE: Flyer will be available after file upload/download problems are resolved.

Hi Friends,
My EAD expires in the mid of August.I am planning to go india at last week of July.I thought of applying for EAD renewal now.But my lawer said it is always preferrable that the candidate must present in US while processing EAD renewal.Is it ok if I apply for renewal after I come back from India.By that time,My EAD already expires.Will it be a problem If I apply for renewal after expiry of current EAD.I am currently on H1B visa and I am not using EAD status now.If it is a problem,I will postpone my India trip.

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

It would be risky.F-1 visa requires strong ties to homeland. Since your parents are already here, it would be difficult for you to prove that you will indeed go back to India on completion of your studies.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. hI ATTY I am working under an h1b visa right now as of 2011. But i had a previous petitioned by another employer way back 2006. There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

Are you allowed to work on H1b for your primary employer and EAD for your own LLC. My wife applied for 485 as a derivative applicant. She has her H1b valid until next year. When she resumed work last year after her pregnancy she submitted her EAD card to the employer's attorney. So far she was under the impression she is now working on EAD. Suddenly the attorney calls her and tells her that they are recommending and H1 extension.
Which is fine if it is possible but in the meantime she has started her own LLC which is likely to generate revenue soon. Is it valid for her to do so while resuming H1b status? Will it be construed that she is working for her own LLC using her EAD.

Following are my case details -
Visa and I94 expiration date: 12 Sep 2009
Filed extension: 11 Sep 2009
Extension denied: 18 Nov 2009
Left US: 15 Dec 2009
Refiled H1 Visa: 15 Dec 2009
Visa apporoved: 22 Dec 2009
What should my answer for following question in DS-156 as I left US within 30 days of receiving the denial letter?
Have you ever violated the terms of a U.S. visa, or been unlawfully present in, or deported from, the United States?
Kindly suggest.

My company applied for my 140 (Substitute) in Premium processing (before it was stopped) and I recieved an RFE for ability to pay. Company took sometime & responded with Tax returns.
Online status says, response to RFE recieved and the processing resumed. Since mine is a PP, I epxected the result in 15 days...but its more than a month...
So I contacted my employer & he says USCIS asked for "Audited Financial statement". But online status did not change. (Still says, we recieved your response & case processing is resumed).
Is it possible that USCIS just asks for more information in reponse to RFE but still does not update the status?? What I don't understand is - normally USCIS Deny the app if they are not OK with my employer's initial response is n't it? how are they coming back & asking for more & more information??
I am confused!! Please throw light if you know more details...

My friend approved PERM in EB2 have qualification 3 year B.SC + 1 Year B.Ed + 2 year MSc. total 6 years of college, filed I-140 and was denied because of education. The labor is for Masters with 0-1 year experience. But they want 4 year degree prior to masters, citing EDGE database. Now the appeal is with AAO.
My question:
1. Do he can apply with the same labor for EB3 ?. What is the chance with two I-140 with same labor ?
( He filed I-140 for EB2 with that labor before 6 months of PERM certification. The PERM certified on April 2009 )
2. Or he need to do a fresh PERM with EB3 as a backup till the AAO verdict ? (takes 22 months)
