In 2005 I (american citizen) applied for a I-130 petition for my husband who is an Indian citizen. (It was approved.) Then after that the case was placed under administrative review at the Mumbai embassy in India. It is still pending for over four years now. As of Sept. 2008 My husband recieved a letter stating the petition was sent to the USCIS here for review and possible revocation. We were told to contact them here for our case. They can not find anything on our case.
He is now in Canada on a student visa. Can I apply for a K-3 visa while he is in canada on a student visa? I was told he would need to go back to India for me to apply for a K-3 visa. USCIS agent told me to take the steps in applying for a K-3 visa for him.

What is unemployment wage report? I read that many visa seekers were asked for this.
Also, they were asked for a notarized list of all the employees with their job title, salary and immigration status. Wow now to get salary information for everyone is breach of privacy.

I personally knows a person who got deported and each and every incidents what happened to him. That happened in Jan-10 but not sure if same thing still continue or not. Because I knows only one incident

A startup in the area filed for my PERM and it was approved in June 2010. Right now, they are in a mess about their tax returns and reauditing with their CPA and it seems that they will not be able to provide tax statements for this year end.
That will cause the PERM to expire without filing I140 since PERM expires in Dec. Is there anyway for us to file extension for the PERM ? More than 180 days...

Thanks for reply. I updated my profile. I just want to know there is going to be only 10 days gap between joining date of new employment and renewal of new EAD, will it create a problem.

Hi,
I am working in company 'A' on H1B, Green card is processing from company 'B' as future employee. Got EAD.
The job is getting over from Company 'A'.
Can I use my EAD and can stay in US with out working to any company?
Will there be any issues if TAX is not paid when I am not working.
If i work part time then on do I need to work for company 'B' only?

My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.

I'm working for Company A and this is my 7th year on H1-B.
I got three years extension last year which is good until Aug'2012 through companyA.(Based on approved I-140 from my previous employer).
My previous employer withdrew my I-140 petition but luckly after getting my 3 year extension with Company A.
Actually,I didn't know that my previous employer had withdrawn the I-140 petition.(Online case status was showing it as approved.) q
I got a very good offer from Company B but I didnt want to take chances with USCIS,so I've told them that I would join only after approval.
CompanyB applied for my H1-B peition asking for 3 year of extension based on I-140 approval.
I was told today that my CompanyB H1-B petition has been denied because of I-140 withdrawal from my previous employer.we didnt know about this because the online case status for I-140 was still showing as approved.
Question
1)Since I've a valid visa until 2012 with Company A. Can company B reappeal the decision asking for H1-B transfer only until 2012.
2)Does the denial has any impact on my current Company A's H1-B petition.
I know it's a tough one but I do appreciate your feedback/help on this issues.

1, How long its taking for PERM processing (including ad etc.,)?
2. Which center is doing PERM faster?
3. will there be any issue if 2 companies file for LC for me in the same center? my current employer is going file LC, but thinking to join some other company.

Hi,
Company B has applied for I-140 and 485 because you will work with them for a min of 6 to 12 months after getting GC.
So its not required for you to join them if they have already submitted I-140 and 485. You can say that you will join them after getting GC.
And if the 485 takes more than 180 days for the approval from the receipt date you can apply the AC21 portability rule and submit a new employment offer from anycompany and you can join that company.(Provided I-140 is approved and if I-140 is pending for more than 180 days then you can port the I-140 priority date by restarting the whole GC process)
Above is the knowledge I got from IV and google.
So u dont need to worry and join the company B, but keep them happy since they have to respond to all RFE till I-140 is approved.
